Forensic Document Examination Evidence IS NOT Governed By Daubert Analysis
Federal court distinguishes between "scientific" and "technical, or other specialized knowledge" for
purpose of Fed.R.Ev 702.
The court declared:
"Because of FDE's use of terms such as "laboratory"
and references to authorities with titles that may contain the words "Science or Scientific", there is a risk that
jurors may bestow upon FDE's the aura of the infallibility of science. In addition, FDE's may use a standard, nine level
scale of probability1that expresses their opinion regarding genuineness in very precise terms. Such overly fine distinctions
are inappropriate in forensic document examination because it is conceded that conclusions are drawn, in large part, on subjective
criteria."
"Forensic document examination is more "skill" than "science"the
U.S. District Court for the Southern District of New York declared on April 4. Therefore, the court held that expert
testimony of a forensic document examiner (FDE) does not have to meet the criteria for the admission of scientific evidence
set out in Daubert v. Merrell Dow Pharmaceuticals Inc., 53 CrL 2313 (US SupCt 1993).

(i.e.) Real or pseudo-DE's usually state in their report and in court: "There is a high degree of probability that
the questioned signature was or was not authored by Mr/s Smith".
This is like a police officer testifying
in court: "Based upon my outstanding and brilliant investigation, it is my expert opinion that there
is a high degree of probability that Mr/s Smith murdered, robbed, stabbed and shot the deceased".
Either
Mr/s Smith did or did not author the questioned signature or commit the crime against the deceased

How Easy Is It To Be Certified As A Pseudo-Forensic
Document Examiner And Fool Clients, Attorneys And The Courts?
From 1993-1996, one well known
Missouri (forensic) Association SOLD certifications as a Forensic Document Examiner for $150.00. Certain individuals
who purchased a phony certification are practicing as a pseudo-document examiner here in MA. Certain others may
be practicing in your state as well.
Certain other Associations that certify members as document
examiners are made up of primarily graphologists/graphoanalysts posing as pseudo-document examiners. Certain of them
are practicing pseudo-document examiners here in MA. Certain others may be practicing in your state as well.
The forged/fraudulent military documents hoax of President George W.Bush as put forth on national television by Dan Rather
was supported by a pseudo-document examiner certified by an association mentioned above.
His incompetence and lack
of proper education and training as exposed by the the national media is a prime example of a pseudo-document examiner.
Certain of these pseudo-document examiner people, especially in Massachusetts, have falsified and/or exaggerated credentials
and perjure themselves in court or in other legal settings.
Since the courts and respective attorneys are not properly
informed about the education and training required to become an authentic document examiner (credential-ed scientist), it
is easy for these frauds to continue perpetrating their hoax upon them.
Due to their incompetence they have to
openly and maliciously lie about their education and training to the detriment of their clients or opposing plaintiff or defendant.
Unless the individual has received the level of education and training as required by and/or equal to that of the
U.S. Secret Service; proper examination of the pseudo-document examiners credentials, education and training will expose them
for what they are ~ frauds who have been successfully fooling their clients, attorneys, courts and others for years.
Do not let these pseudo-document examiners fool you.
